Protesters are taking to the streets of New York City and other cities after a grand jury voted not to indict an NYPD police officer over the chokehold death of Eric Garner. Department of Justice will open civil rights investigation in the case.

Reports of pepper spray being used are now coming in. Although police have reportedly used pepper spray on protesters, one NYPD officer apparently used it on himself by accident. According to Breaking911, the EMS is responding to the report.

One policemen sustained minor injuries after demonstrators threw projectiles at police in Berkeley, California, Berkeley police Officer Jennifer Coats told local reporters.

The incident happened at a rally of 400 people that turned violent in the area of University Avenue and Martin Luther King Jr. Way.

Because of civil unrest, Berkeley's Bay Area Rapid Transit (BART) closed at around 7 pm, BART officials said.

Despite the rain, small protests have broken out in multiple spots in New York City, including the Apple Store, Macy's in Herald Square, Grand Central, and Bryant Park.

Protesters also passed out a list of demands. They are calling on the NYPD to fire Daniel Pantaleo, the officer who performed the chokehold on Garner, and for a special prosecutor to be appointed to investigate the incident, among other things.

Over 200 people were arrested at several splinter protests throughout NYC Thursday night, reports ABC. Protesters were cited for disorderly conduct or refusal to clear the streets, police told the broadcaster.

New York City Mayor Bill de Blasio said the city’s police force will undergo a “full retraining” in the wake of the grand jury’s decision not to indict the officer who killed Eric Garner.

From New York Police Department headquarters, de Blasio said the plan will change how officers interact with civilians and aim to slow down “interactions that sometimes escalate too quickly” and teach cops to use “less force whenever possible.”

There is “a fear” of police among the youth and their parents, and that is “a history we have to overcome,” New York City Mayor Bill de Blasio said.

Some just don’t feel safe around police, and that’s “the reality,” de Blasio added.

He also stressed that he’d had to teach his African-American son Dante how to face encounters with law enforcement.

Referring to protesters, Gwen Carr urged them to remain peaceful.

"We need peace. We want you to rally, but we want peace. Do what you have to, but do it in peace."

Esaw Garner, Eric Garner’s widow, said she is not giving up in her fight to get justice for her husband.

"I am determined to get justice for my husband because he shouldn't have been killed in that way,” she said. “My husband’s death will not be in vain. As long as I have breathe in my body I will fight the fight.”

Garner’s mother, Gwen Carr, added that she is happy the federal government is investigating the incident, but that the grand jury decision makes people more skeptical of the justice system.

“I am truly disappointed with the grand jury’s decision this evening. I don’t know what video they were looking at,” she said.

"We have no confidence in local state prosecutions, because state prosecutors work hand in hand with the local police," said the Rev. Al Sharpton. Sharpton says families of Eric Garner and Michael Brown do not want violent protests.

Attorney General Eric Holder announced the Justice Department will conduct a federal civil rights investigation into Garner's death. Prosecutors will conduct an independent, thorough, and fair investigation, he said, including a "complete review" of material gathered during the local investigation.

Holder called on protesters to shy away from violence.

"I urge all those inclined to demonstrate tonight and in the days ahead to remain peaceful,” he said.

The US Justice Department will announce Wednesday that it is opening a federal civil rights investigation into the death of Eric Garner, who was killed by a chokehold at the hands of police.

“It’s a very emotional day for our city,” said New York Mayor Bill de Blasio, speaking to the public after the decision was made. He said Garner is “a man who should be with us, and now isn’t.”

“No family should have to go through what the Garner family went through.”

The mayor went on to say that the decision puts in stark perspective the relationship between police departments and the community.

“We’re not just dealing with a problem in 2014… We are dealing with centuries of racism that brought us to this day,” de Blasio said. “That is how profound the crisis is.”

President Obama briefly commented on the Garner case, saying it continues to highlight the need for better relations between police and the communities they serve.

“We are not going to let up until we see a strengthening of the trust and a strengthening of the accountability that exists between our communities and our law enforcement.,” he said.

"I'm not interested in talk, I'm interested in action and I am absolutely committed as president of the United States to making sure that we have a country in which everybody believes in the core principle that we are equal under the law."

A New York City grand jury has decided not to indict the New York Police Department officer accused of killing the 43-year-old unarmed Eric Garner by putting him in a prohibited chokehold.
